Booking Conditions.

Laureema Villa is a privately owned property and as such we ask our visitors to treat the Villa with the utmost respect.  We want you to enjoy your vacation in this house and therefore request that you leave the Villa in the condition you would wish to find it at the beginning of your stay. The terms and conditions are supplied in order to inform you how the booking procedure for Laureema Villa is operated and also explains how the cancellation procedure works in the unlikely event that you have to cancel a booking. These terms and conditions are in no way intended to confuse you nor bind you to an unreasonable contract. If at any point you do not understand any of the terms or would like to discuss them with us in person then please do not hesitate to contact us.

The booking form (which will be sent to you by email) must be completed by the party leader (the client) who must be over 18 years of age. The completion of the booking form shall be deemed as an acceptance of the booking and our terms and conditions by the client and shall be a warranty by the client that they have the authority to act on behalf of the persons named on the booking form including any substitutions or additions by any subsequent agreed amendments to the booking.

The booking is not accepted until the completed booking form and payments have been received into our account – a payment by cheque or any other un-cleared form of payment will not be accepted until successful clearance shows in our account. A booking is only confirmed once an acknowledgement or receipt has been issued to the client. An invoice or pro forma invoice does not constitute an acknowledgement of a booking. If the booking is not accepted by us for any reason the deposit will be refunded in full. Amendments to or cancellation of a booking by the client will be subject to the provisions of sections 5 & 7 of these terms and conditions.

The accommodation cannot be shared, assigned or sublet and only the persons shown on the booking form are permitted to stay in the property. The property sleeps eight people with an additional two people on a sofa bed if required (but not recommended). No all male or all female groups permitted unless previously arranged. The maximum number of people allowed staying in the villa at anyone time is 10 People.  Children under the age of 18 are not permitted to stay unless accompanied by parents or an adult.  No pets permitted.

A non-refundable deposit of 10% of the total booking fee is required at the time of booking and the balance is payable 8 weeks prior to the date of departure. If the booking is made 8 weeks or less from the date of departure, the full amount is required at the time of booking. The deposit will be treated as part payment of the total amount due.  If the balance is not paid 8 weeks prior to the departure date, the owners shall have the right to cancel the booking without further notice. In the event of cancellation for any reason, deposit and final balance are not refundable.  The owners are not responsible for any loss of enjoyment or use of the house due to travel disruption.  It is very important that you have adequate insurance cover and is a condition of this booking.

Guests are required to take out travel/holiday insurance when booking to protect against cancellation costs. The Owner or his Agents accept no liability or responsibility whatsoever for personal injury or accident, loss or damage of personal effects whenever or however caused.

The client is responsible for and pays all travel arrangements, airline tickets, car rental, medical and travel insurance and any other costs incurred in connection with the holiday. Payment via the Booking Form is for the rental of the villa only.

The villa is available for occupation from 4pm (local time) on the day of arrival until 10am (local time) on the day of departure. Vacating after 10am on agreed day of departure may incur additional charges amounting to two full day’s rental during which you will not be allowed to stay and your departure date remains the same as indicated on your booking form. Rentals of less than 7 days will incur a cleaning charge as outlined on the web page.

We accept no responsibility for price discrepancies on our website or any other marketing material you may see relating to Laureema Villa.  All prices will be agreed confirmed at time of booking. The rental price for the villa is fully guaranteed when the deposit has been paid and the acknowledgement/receipt has been issued.

The effective date of any amendment is the date on which details of the proposed amendments are received in writing.

The client is solely responsible for any damages, stains or breakage(s) that may be caused to the property or its contents and also for any loss in the inventory during their stay. We require the client to arrange a security deposit with our management company where you credit card details will be requested in order to pre-authorise a deposit amount which will not be used providing the house is left in a satisfactory condition. The villa is inspected both before and at the end of each occupation to check that all is in order; this is done by the Management Company prior to cleaning.  Charges for damages/losses or any maintenance/repairs to the premises, equipment, amenities or fixtures necessitated by misuse or neglect will be at the discretion of Laureema Villa.

It is important that the property be left clean and tidy at the end of the rental period.

Any cancellation by the client must be notified in writing directly to Laureema Villa, 4 Park House Drive, Sandbach, Cheshire. CW11 1YW, United Kingdom.  Cancellation by telephone will not be accepted, however, we would appreciate contact as soon as possible to inform us that you need to make a cancellation and that you will be issuing us with the appropriate cancellation details in writing.

In the event of cancellation by the client, the following charges will apply:-

• Cancellation more than 8 weeks - Loss of deposit
• Cancellation 6-8 weeks prior to departure - 50% of full rental charge
• Cancellation 4-6 weeks prior to departure - 75% of full rental charge
Less than 4 weeks - no refund
• It is a condition of booking that you travel with adequate insurance and it is recommends you cover yourself against cancellation which is not always standard in policies.

In the unlikely event that circumstances beyond our control necessitate cancellation, we will refund any monies paid by the party leader (without interest, compensation or consequential loss of any kind). In this unlikely event, as a good will gesture only, we will always attempt to find you alternative accommodation in a villa of similar or superior quality on the same or similar community – however we are not liable to compensate for any difference in price and you will be subject to the terms and conditions of the that accommodation owner.

No smoking is permitted inside the property and only permitted around the pool deck and lanai area. If the Owners or Owner’s management company find any evidence of smoking inside the villa or garage, it will be regarded as a serious breach of contract and the Guests will be evicted immediately. All monies paid will be forfeited. Failure to leave the premises under these terms will result in enforced action by the local Sheriff or Police. Any costs incurred in the neutralisation of odours, or making good any damage to the property (such as, but not limited to, burn marks, discoloration or disfiguration) from cigarettes, cigars, pipes or other smoking materials, will be deducted from the security deposit paid by the Guest. In the event that the security deposit does not cover the cost of repairs the Owners reserve the right to reclaim from the Guest any and all of the additional costs involved.  Any marks on the pool deck area from smoking materials will also attract additional cleaning costs (the extinguishing of cigarettes on the pool deck or furniture).

No pets or animals are allowed in the villa, garage or pool area at any time. If pets or animals are found on the premises it will render the booking void, all monies paid will be forfeited, all occupants will be asked to leave the villa immediately with no further compensation and the cost of a thorough deep clean of the property will be deducted from the security deposit. In the event that the security deposit does not cover the cost of the thorough deep clean or the cost of repairing or making good any damage, the Owners reserve the right to reclaim from the Guest any and all additional costs incurred.

The reason for this is that future guests could have allergies towards certain animals and therefore the decision is not to allow any pets of any kind into the villa.

11. POOL
The depth range of the pool is approximately 3 feet to 5 feet. The pool is regularly cleaned; inspected and maintained but may be affected by dust, dirt or insects, particularly during or after bad weather.  Guests may use the swimming pool at their own risk.
It is strongly recommended that children be supervised at all times in and around the pool area as well as the facilities on the development.  Diving is not allowed at anytime in the pool. A safety fence is supplied and runs the whole length of the pool and is there for the well being of small children. This can be removed at the discretion and responsibility entirely of the guest.

For your own safety we suggest that you enter the Villa from the Pool area via the exterior door to the Master Bedroom en-suite facility.  This will reduce the potential for slippery surfaces being created in the family room area and other parts of the Villa.

Glass or crockery is not permitted in the pool area - plastic ware is supplied for use outside the Villa.

Pool heating will be switched on during the day ordered as we cannot turn the pool heating on whilst the villa is occupied by other clients.  It may take some time to heat the pool to optimum temperature, depending on the ambient air temperature. We cannot guarantee the temperature of the pool as this varies according to local factors, especially the prevailing weather conditions.

If a pool blanket is available it must be removed before any person enters the pool.  We do ask that you cover the pool with the blanket overnight to prevent heat loss from the pool when the air temperature drops.

The Owners are not responsible for the weather and if the client has paid for pool heating and finds the weather and pool temperature is warmer than expected our manager will turn the heater off if requested to do so, but no refund will be given for the unused portion of the pool heating charge.

The heater is a mechanical device. As with any mechanical device, it can be subject to electrical/mechanical failure. In the unlikely event of a breakdown every effort will be made to repair the heater as quickly as possible. If the client has paid for pool heating, then we shall refund, from the heating charge, only the days you are without pool heating.  No additional compensation will be paid.

Occasionally, during the winter months if the air temperature drops very low, the heater and pump cut out as a safety feature.  However, as we have a gas heater (unlike a other villa which have heat pumps) this is very unlikely).  If the client has paid for pool heating, then we shall refund, from the heating charge, only the days you are without pool heating.  No additional compensation will be paid.

The pool heater must be switched on and off by a technician authorised by either the Owners or the Owner’s management company. The client must not tamper with, interfere with, or attempt to change any of the pool heater settings. Any attempt by the client to change the pool heater settings will render the booking void, all monies will be forfeited and all occupants will be asked to leave the villa immediately with no further compensation.  To prevent this, the pool heating controls have been locked.

The code number to the front door will be advised to our client at the same time of booking.  This number is always changed each and every booking to the Villa and will be set on the day of your arrival.  You should not attempt to change the code at anytime.  If the code is changed, this will be deemed as a breach of contract and any remedial action will be charged against the security deposit.

In the event you forget the code number to the front door, the code number to the villa’s key lock box (located by the front door) can be obtained from our Management Company.  The Management Company will change the code the next day and reset the front door code for you. This number must not be divulged to anyone other than those people occupying the villa. The client is responsible for the key codes at all times during their stay at the villa. Should you use the physical key, please return the key to the lock box every time you leave the property. This will reduce the risk of the key being lost or stolen. If the key is lost or stolen, the client will be responsible for any costs associated with the replacement of keys, locks and any damage incurred to re-enter the property.

Please do not move the pool table as it has been levelled. The internal door to the house must be kept closed at all times and please use the fans provided for cooling.  Leaving the door open will cause the air conditioning unit to malfunction.  For security purposes please lock the internal door and switch off the fans and lights as you leave.  Any major damage caused to the equipment supplied in the games room will be charged to you.  This could be anything from minor rectification to full replacement.  We therefore recommend that any usage of the equipment is supervised by an adult.

14 (a) Within the Villa you will find a home entertainment centre that includes a Nintendo Wii system and DVD player.  Usage of the Wii system must be supervised by an adult as any damage caused to the system or controls will be charged back to you upon departure.  The system will have a copy of the Nintendo Wii Sports disc and Wii Games disc that must remain in the Villa after departure. Failure of this will result in a charge for replacement.

14 (b) The large format LCD Monitor/TV settings must not be altered in any circumstances to ensure the incoming renters enjoy the best performance from the equipment.  The only exception to this is if the channels become detuned which could happen during inclement weather period.  If this should happen the client may retune the set using the instructions inside the manual) or call the Management Company for assistance.

15. WIFI
In order for all of our guests to enjoy this complimentary service we ask that you DO NOT change any leads or connections going into the phone jack.

Do not attempt to change any settings on the modem regardless of whether you have the technical knowledge to do so.

Do not tamper with or attempt to unplug the modem for any period of time.

Failure to comply with these notes may result in the necessity of a site visit from the Internet Service Provider for which you will be billed.

We accept no responsibility for this service not being available due to a technical or service provider fault.

It is forbidden to download any adult content what so ever.  The audit trail will be viewed to ensure this has not happened.

We strongly advise our clients to take out Travel insurance for their whole party.  Clients are personally responsible for the provision of international travel/health documentation.  Cancellation caused by clients due to the incorrect documentation will be charged the relevant cancellation fee.

Laureema Villa and their representatives accept no responsibility whatsoever and no compensation or any other payment will be made if any cancellation, or change to the terms of the booking becomes necessary due to war or threat of war, riots, civil commotion, terrorist activities, industrial disputes, natural and nuclear disasters, fire, flood, adverse weather conditions, technical problems with transportation, closure or congestion of airports, alterations or cancellation of schedules by carriers, or any other events beyond their control.

Should any problem occur with the accommodation during your stay, you must notify the local Management Company immediately. The telephone number of the Management Company will be provided to you before departure.  If the matter is not rectified to your satisfaction, you should contact us directly.

Whilst all information is deemed to be correct and to the best of our knowledge, it is understood that the information and photographs supplied is for guidance purposes only and does not form part of any contract.

Although every effort is made to ensure that the villa is in perfect condition, Laureema Villa cannot accept responsibility for third party claims, accidents, damage to or loss of property or for any expenses incurred for any reason including changes caused by force majeure, regardless of however they may have occurred, nor can any responsibility be accepted for injury or accident caused as a result of the use of the pool.

Guests are specifically requested not to allow children to use the pool unsupervised and to follow the guidelines set out displayed by the pool and in the villa information book. We also take no responsibility for accidents or injury as a result of slippery surfaces, by not using the safety screen or any other third party claim of any description.

21. LAW
This contract is subject to and shall be in accordance with the laws of England and shall be subject to the jurisdiction of the English Courts.

The Owners Lock-Up is located in the kitchen area.  This cupboard is for the exclusive use of the Owners and is clearly marked “PRIVATE”.  Any indication that there has been an attempt to enter this lock-up will be regarded as a serious breach of contract and the Guests will be evicted immediately. All monies paid will be forfeited. Failure to leave the premises under these terms will result in enforced action by the local Sheriff or Police.  The local Sheriff will also be informed of the incident.

If any indication of attempted entry is discovered after the Guests have departed they will be informed and relevant measures taken to recover costs of repair or any missing items.  A full report will be sent to the law enforcement agencies for follow-up.

23. BBQ (if supplied)
If the owner supplies a BBQ free of charge it is the responsibility of the client to ensure it is cleaned completely after use and left in a condition fit for immediate use by the next client.  If this is not done, to the satisfaction of the Management Company who will inspect the BBQ, a cleaning charge of $75 will be levied against the security deposit held by the Management Company.
